Unresolved disputes involving property use, leasing/rental agreements, and other breaches of contract can be frustrating for both the landlord and tenant. In most cases, both parties want the same thing for the matter to be resolved as quickly as possible.
The landlord, as the owner of the property, is responsible for ensuring the property is maintained and collects on rental payments and other payments from the tenant. The landlord can face issues such as unpaid rent, illegal use of the property, destruction of the property and/or other breaches of the leasing/rental agreement. The tenant in turn is responsible for paying their rent to the landlord and can faces issues that revolve around eviction. In either case, both parties have rights that should not be overlooked and should be protected.
If a dispute could not be settled between the two parties, remedies can be sought from the court system. Remedies can be applied for at the Landlord Tenant Board (LTB), Provincial Courts for remedies in excess of $50,000 and Superior Court of Justice for bigger disputes.
